1. Introduction

These Terms & Conditions (“Agreement”) govern the relationship between:

  • BookMyHostel (Company): Habinex BookMyHostel Pvt. Ltd., which operates the BookMyHostel platform.
  • Hostel Partner (You/Your): The hostel/PG owner, operator, or manager registering with BookMyHostel.

By registering as a Hostel Partner, you agree to comply with and be bound by these terms.

2. Role of BookMyHostel

  • BookMyHostel acts as a technology intermediary platform to list hostels/PGs, accept bookings, and facilitate rent payments.
  • BookMyHostel is not a landlord, property manager, or financial institution.
  • All tenancy, stay, rent, and deposit arrangements are directly between the Hostel Partner and the User (Tenant).

3. Obligations of Hostel Partner

Accuracy of Information

  • Hostel Partner must provide true and accurate details about property, pricing, facilities, and rules.
  • Misrepresentation may lead to suspension or termination of the listing or account.

Legal Compliance

  • Hostel Partner must comply with applicable laws, including but not limited to:
    • Shops & Establishment Act
    • Local Municipality/State Licensing Rules
    • Income Tax Act & GST (if applicable)
    • Privacy & Data Protection Laws
  • Hostel Partner shall be solely liable for any legal or regulatory non-compliance.

Guest Verification

  • Hostel Partner must conduct tenant verification (ID Proof, Police Verification, etc.) as per applicable state/local laws.

Pricing & Cancellation Policy

  • Hostel Partner must declare their cancellation/refund rules clearly in advance.
  • These rules shall be displayed to Users during booking.

4. Payments & Settlements

  • BookMyHostel collects booking/rent amounts from Users via third-party payment gateways.
  • After deducting applicable service charges, GST, or transaction fees, the net amount is settled to the Hostel Partner’s registered bank account.
  • Settlement timelines: T+2 to T+5 business days (subject to banking networks).
  • BookMyHostel is not responsible for delays caused by banks, NPCI, UPI, or payment processors.

5. Refunds & Chargebacks

  • Refunds shall be processed as per Hostel Partner’s published cancellation policy.
  • In case of chargebacks/disputes from Users or banks:
    • Hostel Partner shall assist BookMyHostel in resolving disputes.
    • Any loss due to wrongful representation, incorrect details, or fraud shall be borne by the Hostel Partner.

6. Security Deposit Handling

  • Hostel Partner is responsible for collection, deductions, and refunds of security deposits.
  • BookMyHostel is not liable for disputes relating to deposit refunds or deductions.

7. Content & Intellectual Property

  • Hostel Partner grants BookMyHostel the right to use property images, descriptions, and logos for marketing & listings.
  • Hostel Partner must not upload copyrighted, obscene, or misleading content.

8. Indemnity

Hostel Partner agrees to indemnify and hold harmless BookMyHostel, its officers, and employees from any claims, liabilities, penalties, or damages arising out of:

  • Misrepresentation of property
  • Violation of applicable laws
  • Tenant disputes
  • Fraudulent or unauthorized transactions

9. Limitation of Liability

  • BookMyHostel shall not be responsible for disputes between Hostel Partner and Users.
  • BookMyHostel’s liability is limited to the amount of service fees charged for the disputed transaction.

10. Suspension & Termination

  • BookMyHostel may suspend or terminate Hostel Partner accounts in case of fraud, illegal activity, or breach of this Agreement.
  • Repeated non-compliance or user complaints may also lead to deactivation without prior notice.

11. Governing Law & Dispute Resolution

  • This Agreement is governed by the laws of India.
  • Any disputes shall be subject to the jurisdiction of courts in Vaishali, Bihar.
